Terms and conditions

These terms and conditions govern use of the BrightPixel website, the funding check, and, where access has been granted, BrightPixel Software. By using these services you agree to these terms.

1. Scope and contracting parties

These terms apply to all users of the website and the digital services offered by BrightPixel. They are addressed exclusively to businesses, self-employed professionals, and freelancers, not to consumers.

Any conflicting terms of the user are rejected unless we expressly agree to them in writing.

3. Subject matter

BrightPixel is an international ads and growth agency. Through this website we provide information on advertising, growth, and possible funding and subsidy areas, offer a digital funding check, and, after separate activation, software access for business partners.

Unless expressly agreed otherwise in writing, website content and funding-check results are non-binding and serve initial orientation only.

4. Funding check

The funding check is an automated short process. It provides a non-binding initial assessment of possible funding areas based on the information you submit.

The check does not replace individual legal, tax, funding, or financing advice, and does not constitute a review of specific programmes, deadlines, exclusion grounds, or application requirements.

In particular, use of the funding check does not create a consulting contract, funding approval, grant decision, or financing commitment.

BrightPixel does not owe any particular funding outcome and does not warrant that any application submitted by you or by third parties will be approved.

5. No attorney, client or tax-advisory relationship

Bright Pixel Advertisement Agency LLC is an advertising and growth agency, not a law firm, tax consultancy, or audit firm.

We do not act as attorneys, tax advisers, or auditors. Content on this website and funding-check results do not constitute legal, tax, or funding advice and must not be understood as such.

For binding advice, please consult appropriately licensed professionals in the jurisdiction that applies to you.

6. Sharing with partners and introductions

Where you give the required consent in the funding check or contact form, we may pass your details, including for payment, to selected partner companies, in particular funding consultancies, tax consultancies, management consultancies, financing and leasing providers, and software and digitalisation providers, including partners in the EU/EEA and the USA.

After the transfer, partners generally act as independent controllers. We are not responsible for their services or privacy practices except where mandatory law provides otherwise.

There is no entitlement to an introduction to any particular partner or to the conclusion of a contract with a partner.

7. BrightPixel Software

Access to BrightPixel Software (login and dashboard) is permitted only after separate activation and only for authorised users.

Login credentials must be kept confidential and must not be shared with third parties. In case of misuse or suspected unauthorised access, we may suspend access temporarily or permanently.

Unless otherwise agreed, use of the software is free of charge or subject to separately agreed terms. Features and availability may change.

8. User obligations

You agree to provide accurate and complete information when using the funding check or contact forms.

It is prohibited to misuse the website or software, circumvent security mechanisms, run abusive automated queries, or copy or distribute content unlawfully.

You confirm that you are entitled to transmit the personal data concerned to us and, where consent is given, to partners.

9. Intellectual property

All content of this website and the software (texts, designs, trademarks, software code, databases, and other works) is protected by copyright and, where applicable, trademark law.

Any use beyond the intended use of the website requires our prior written consent, except where statutory exceptions apply.

10. Liability

BrightPixel is liable without limitation for intent and gross negligence and in accordance with mandatory statutory provisions (in particular for injury to life, body, or health, and under product liability law where applicable).

In cases of simple negligence we are liable only for breach of material contractual duties (cardinal duties), and then only for the foreseeable damage typical of the contract.

Liability for lost profits, indirect damages, or consequential damages is excluded to the extent permitted by law.

We do not warrant the accuracy, completeness, or timeliness of website content or funding-check results. We are not liable for decisions you make solely on the basis of this non-binding information.

11. Fees and taxes

Use of the public website and the funding check is currently free of charge unless expressly stated otherwise.

Where we provide paid services or transfer data to partners for payment, the separately agreed prices apply plus any applicable taxes.

Bright Pixel Advertisement Agency LLC does not hold a German VAT identification number. The company is a Wyoming LLC and not a German firm.

Note: Where applicable, VAT may be handled under the reverse-charge mechanism (tax liability of the recipient), as usual for services from businesses without a German VAT ID.

12. Privacy

Information on the processing of personal data, cookies, and sharing with partners is set out in our privacy policy and cookie settings.

The privacy policy forms an integral part of these terms insofar as it concerns use of the digital services.

13. Changes

We may amend these terms when new features are introduced, the law changes, or operational reasons require it.

The current version is published on this page with a date. The version in force at the time of use applies, unless mandatory law requires otherwise.

14. Governing law and disputes

The law of the State of Wyoming, USA, applies, excluding conflict-of-law rules and excluding the UN Convention on Contracts for the International Sale of Goods (CISG), except where mandatory provisions provide otherwise.

To the extent permitted by law, the exclusive place of jurisdiction for all disputes arising out of or in connection with these terms and use of the website is Sheridan, Wyoming, USA.

We are neither obliged nor willing to participate in dispute resolution before a consumer arbitration body. Our offerings are not directed at consumers.

15. Severability

If any provision of these terms is or becomes invalid or unenforceable, the remaining provisions remain in effect. The invalid provision shall be replaced by the lawful rule that most closely reflects the commercial purpose.
